Definition

What is Title Examination?

Title Examination is the process of reviewing and analyzing the information collected during a Title Search to determine the legal status of a property's ownership and identify any issues that may affect the transfer or insurability of title.

The examiner evaluates the chain of title, recorded documents, liens, judgments, taxes, easements, restrictions, and other public records to determine:

The Examiner Determines
  • Who legally owns the property
  • Whether the seller has the legal right to transfer ownership
  • Whether there are outstanding liens or encumbrances
  • What requirements must be satisfied before closing
  • What exceptions should appear on the title commitment
  • Whether the title is marketable and insurable
